1. Introduction

Below you will find the contractual document that will govern the purchase of products through the website embutidosezequiel.com, property of Fábrica de Embutidos y Jamones Ezequiel, S.L.
Please, read carefully the present "General Contracting Conditions" (hereinafter, the "Conditions"), as well as our Legal Notice, Privacy Policy and Cookies Policy (jointly, the "Data Protection Policies") before using this Website. If you do not agree to these Policies, you should not use this Website.

2. Identification

The sale of products through the Web Site embutidosezequiel.com, is carried out by Fábrica de Embutidos y Jamones Ezequiel, S.L. (hereinafter the provider), with C.I.F.: B-24235129; Spanish Company with registered office in Villamanín de la Tercia (León), Carretera Nacional 630, Km 99,5 (C. 3. Use of our Website

The purpose of this document is to regulate the contractual relationship that arises between the provider and the user (hereinafter, "the customer") when the latter accepts the transaction during the online purchase process through the corresponding box.

The contract shall be concluded in the Spanish language, the language in which the "Conditions" are available on our Website.

By making use of the Website and placing orders through it, the customer declares to be a person of legal age, with legal capacity to contract and agrees to:

- Accept the "Conditions" from the moment he/she purchases any product. This document may be printed and stored by the customer.

- To use this Website only to make legally valid enquiries or orders and not to place any false or fraudulent orders. If we reasonably believe that such an order has been placed, we will be entitled to cancel the order and inform the relevant authorities.

- Provide a valid and up to date email address or other contact details so that we can make use of them if we need to contact you about any matter relating to your order. If you do not provide us with the information we need, we will not be able to process your order.

 

4. Standards applicable

These Conditions are subject to the provisions of Law 7/1998, of 13 April, on General Contracting Conditions; Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws; Law 7/1996, of 15 January 1996, on the Regulation of Retail Trade; Royal Decree 3423/2000, of 15 December 2000, which regulates the indication of the prices of products offered to consumers and users and Law 34/2002, of 11 July 2002, on Information Society Services and Electronic Commerce.

 

5. How to place an order

To place an order, please follow the steps below:

1. Your shopping cart

Select the product: You must enter the section "Our shop" and select the product you are interested in. Once you have chosen the product you are interested in, you must click on "add to cart".-

Your basket: Once the products have been successfully added to your basket, you will be able to see a summary of the products and the costs of your order. You can continue shopping or finalise your purchase.

Finalise the purchase: Once the order has been completed, we will give you a summary of the order and you will be able to apply discount coupons if they are available at the time of purchase. You must check that the order is correct and click on the "Finish" button.

2. Data and payment

Identification: Once you have completed your purchase, we need you to provide us with an email address to finalise your order. If you are interested in receiving e-mails with commercial information, you must tick the box "send me news and offers by e-mail" so that we have your express consent. We remind you that you can unsubscribe and revoke your consent at any time, in which case we will not send you any more commercial information.

Shipping address and billing information: We need you to provide us with a shipping address and billing information in order to process the order correctly. You must also tell us if you need an invoice and select a payment method from the following:

PayPal: PayPal is a secure payment system, with which the order is automatically validated at the end of the process.

Debit or credit card: The customer will pay by credit or debit card through a secure payment gateway. Once the order is confirmed, the order will be processed automatically. For credit card orders that are not accepted by the bank, the order will be cancelled automatically, so you can place the order again with another card or payment method.

Cash on delivery: The order will be processed immediately. There is an extra charge of 2,95 €. The total amount of the order will be paid in cash to the carrier at the time of delivery.

Bank transfer: The customer must transfer the exact amount of the order to our bank account number. It is important to indicate the order number as the concept of the transfer to be able to locate the payment as soon as possible.

Bizum: Once you have selected Bizum as a payment method, in the payment gateway, enter your phone number and the Bizum key (which you can obtain from the bank's APP). If your bank does not have the Bizum key, it means that it is working to offer e-commerce payments. Another possibility is that your bank already allows you to complete Bizum payments directly in its banking APP; for this, you will only have to enter your phone number at the time of payment and you will receive a notification from your bank to complete the payment in its application

3. Order placed

When processing the order, you must confirm that you have read and accept our "Conditions" and "Data protection policies".

Once the order has been completed, you will receive an email within 24 hours of receipt of your acceptance acknowledging receipt of your order. If you detect any fault in your purchase, all you have to do is send us an email to [email protected] or call us on (+34) 987 59 85 13.

The payment confirmation will be automatic with Paypal, Bizum, or credit card payment methods; however, if you choose bank transfer as your payment method, the shipment may be delayed, as it could take up to two days for the order to be validated.

 

6. Shipments to Spain and Portugal (except islands)

Shipping to mainland Spain and Portugal costs €4.95 (VAT included), unless the order exceeds €75.00, in which case, shipping will be free.

If the shipment is to the Balearic Islands, it will cost 12,95€ (VAT included). This delivery will never be free of charge, regardless of the amount of the order.

In the case of the Canary Islands, the order must be placed by telephone or email, and is not available through the Website. Nor will there be free shipping costs, which will be calculated according to the weight of the package. In the case of shipments to the Canary Islands, the provider is not responsible for any possible extra charges generated by customs.

We do not ship to Ceuta, Melilla, Andorra or Gibraltar, nor to the islands of Portugal.

 

7. Shipments to Europe

In this type of shipment, the amount of the shipment will depend on the weight of the order, which will be indicated in the purchase process. In no case will there be free shipping, regardless of the amount of the order. We do not ship to islands or territories with special tax zones, such as San Marino, Vatican or Corsica.

In the case of orders to the European Union, they will be shipped to all the countries listed in the table below:

8. Product availability

All orders are subject to product availability. If there are difficulties in the supply of certain products or if there are no items in stock, we will refund any amount you may have paid.

 

9. Delivery of orders

Unless there are unforeseen or extraordinary circumstances, once the order is ready, we will send it to you and it will be delivered to the address you have given us within 24 to 72 hours from the date it leaves the factory.

For orders with deliveries outside the Iberian Peninsula, the delivery time is between 4 and 8 working days.

If the area is remote, the agencies do not come every day and the transit may take more days.

If for any reason we are unable to meet the expected delivery date, we will inform you of this circumstance to the email address you have provided and we will give you the option to go ahead with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. 
Please note, however, that we do not deliver to your home on Saturdays or Sundays.

If we are unable to deliver your order, it will be returned to our warehouse. However, the transport agency will try to contact you to facilitate delivery.

If you are not going to be at the place of delivery at the agreed time, please contact us to arrange delivery on another day.

 

10. Return policy

Right of withdrawal

You have 14 natural days from receipt of the order to exercise your right of withdrawal, i.e. to return the goods for no reason.

In these cases, the goods must be in perfect condition, without the packaging having been opened and, in addition, as they are food products, they must be in a perfect state of conservation.

To proceed with these returns, you must first contact us indicating that you wish to return the goods. Then, you must send it, assuming the costs that may arise, to the following address:

Once your return arrives at our facilities and we verify that everything is in perfect condition, we will refund you the amount within a maximum period of 15 days, through the payment method you used to pay for the purchase. In the event that it is not possible to make the refund by the original method of payment, it will be made by bank transfer.

Remember that if you applied a discount code when placing this order, this means that you paid less for each item. Therefore, upon refund, we will refund you the actual purchase price you paid, which is the price of the product minus the discount.

Mistaken orders or products in poor condition

If the order was sent with errors (either because not all of the products were sent or because they were wrong), you must contact us within 5 calendar days of receiving the order to rectify the problem.

If the products were in poor condition, it may be justifiable that the problem was not visible when you received the goods. In this case, you can make the claim later, but always before reaching the expiry date of the product.

In such cases, we will bear the costs of the return and a new shipment, if applicable.

Return conditions

Our products have an additional guarantee that extends the security and peace of mind of the consumer. This additional guarantee means that as long as a product is in date (i.e. a product whose best before date has not been exceeded), we are responsible for any type of incident that may occur in the product (taste, smell, condition of the product, etc.) as long as the product has been kept according to the conditions established on the labelling.

 

11. Value Added Tax and invoicing

The applicable VAT rate shall be that legally in force at any given time depending on the specific article in question.

 

12.   Liability and disclaimer of liability

Except as otherwise expressly provided in these Conditions, our liability in relation to any product purchased on our Website shall be strictly limited to the purchase price of such product.

However, unless otherwise provided by law, we will not accept any liability for the following losses, howsoever arising:

- loss of revenue or sales;

- loss of business;

- loss of profits or loss of contracts;

- loss of anticipated savings;

- loss of data;

- loss of management time or office hours.

Due to the open nature of this Website and the possibility of errors in the storage and transmission of digital information, we do not guarantee the accuracy and security of information transmitted or obtained through this Website unless otherwise expressly stated on this Website.

 

13.   Written communications

Applicable law requires that some of the information or communications we send to you be in writing. By using this Website, you agree that most communications with us will be electronic. We will contact you by email. For contractual purposes, you consent to use this electronic means of communication and acknowledge that all contracts, notices, information and other communications that we send to you electronically comply with any legal requirement that they be in writing. This condition will not affect your statutory rights.

Accordingly, all notices, demands, requests and other communications to be given by the Parties in connection with these Terms shall be in writing and shall be deemed to have been duly given when delivered by hand or sent by ordinary mail to the other party's address or e-mail address, or to such other address or e-mail address as either party may provide to the other party for this purpose.

 

14. Invalidity and ineffectiveness of provisions

If any clause included in these Conditions is declared totally or partially null and void or ineffective, such nullity or ineffectiveness shall only affect such provision or the part thereof that is null and void or ineffective, and the Conditions shall survive in all other respects, and such provision, or the part thereof that is affected, shall be deemed not to have been included 

 

15.   Our right to change these Terms

We reserve the right to modify these Terms and Conditions by giving Customers sufficient notice in order to improve the services and/or products offered through our Website.

By means of the modification of the Conditions exposed in embutidosezequiel.com, it will be understood that this duty of notification has been fulfilled.

In any case, before using the services and/or contracting products, the General Conditions may be consulted.

 

16.   Applicable law and jurisdiction

The use of our Website and the purchase of products through this Website shall be governed by Spanish law. The provider and the client (user) agree to submit any dispute that may arise from the provision of the products or services covered by these Conditions to the Courts and Tribunals corresponding to the domicile of the user.

Likewise, the provider and the client (user) may submit their disputes to the arbitration provided for in the legislation on arbitration and the defence of consumers and users, and to the procedures for the extrajudicial resolution of disputes established by means of codes of conduct or other instruments of self-regulation.
